Azerbaijan Republic State Property Management Committee in the presence of responsible persons, managers of territorial departments and subordinate agencies held a conference dedicated to the results of January-April 2009 and forthcoming issues.

Committee chairmain Kerem Hasanov opened the conference with statement and said that the development conception of Azerbaijan set by the Great Leader  Haydar Aliyev is successfully carried on by the Prezident Ilham Aliyev. The importance of the management and privatization of the state property in the realized successful reforms was noted. It was stated that the works concerning the sphere were produced in accordance with the social-economic development programs approved by the President of the Azerbaijan Republic.

The committee chairman speaking about the works carried out in January-April, 2009 said that the in the process of privatization a great significance was attached to the increase of transparency, enhancement of efficiency in the management of the state property, the resumption and development of the privatized institutions, the opening of new jobs, the control over investments into the privatized enterprises.

The attendees of the conference were informed that in January-April of the current year the works on the drafts of about 20 normative and legal documents drawn in the previous periods for the normative and legal basis regulating the management and privatization of state property and submitted for approval are continued.

In the first four months of 2009 about 250 small enterprises and objects throughout the republic were privatized. In the past period of 2009 the ground area embracing about 190 objects was privatized. 4 stock companies were formed as a result of transformation of state enterprises. In the 16 auctions held for the privatization of stocks, stocks of 21 stock companies were privatized. to, payment of dividends to the state budget for stocks owned by in the Chartered capital by about 40 stock companies was ensured. The capital in the amount of about 30 mln manats was placed into the enterprises privatized through contest by the winners of the contest.   In general the investment  contest held within the privatization process about 430 million manats were invested into 82 privatized enterprizes and approximately 12,5 thousand jobs were opened in the enterprises. In the past period of 2009, the property right to 3 enterprises privatized through investment contest (“Jeyranbatan SutikintitÉ™chiza” OJSC, “Imishli Yol Tikinti-6” OJSC and “Republican Dental Center” OJSC) was given to the buyers.

By 01.05.2009, in accordance with the legislation about 23,6 mln pcs of privatization cheques and about 10 mln pcs privatization options were covered within the privatization process.

In January-April, 2009, the appropriate measures related to the execution of the “State Program for improvement of the state property management in the Azerbaijan Republic” approved by the Order of the President of Azerbaijan Republic “On the improvement of conservation and sustainable use of the state property” No. 586, dated June 6, 2007.

The works related to the conservation and protection of the state property, its sustainable use, lease and use of the movable property, survey of the use conditions of ground areas covering state and privatized enterprises and objects, monitoring the activity of state enterprises after privatization, taking of reports and inventory acts from the enterprises and their analysis were carried out.

Monitorings for the detection and prevention of the breach of legislative requirements to the ground areas covering state property, as well as to the privatized enterprises and objects were continued. In the result of the produced investigation the cases of illegal use were detected on the ground areas of more than 100 enterprises and objects in general. Appeals appropriate state agencies for the measures to be taken in this connection were made. At the same time, actions against more that 25 objects were taken to the court.

Necessary measures for the drawing of the System of State Property Management (SSPR) within the Registration of Immovable Property Project realized by the World Bank.

In order to investigate the condition of existence, conservation and sustainable use of the state property, calculation and payment of dividends to the state property, in the stock companies with a state share in the chartered capital, state enterprises and institutions were held about 90 monitorings.

About 240 balance reports and 360 inventory acts were accepted from the stock companies with state share in the chartered capital. 150 balance reports and about 190 inventory acts were accepted from the state enterprises that are at the command of the committee.  “Annual special report forms about the conservation and usage conditions of the state property” for the results of the 2008 were received from about 4810 state enterprises and institutions. Monitorings of the fulfillment of the conditions and maintenance of the activity profile after the purchase and sale contract were held in about 50 objects.

About 8600 information notes about stock companies, state enterprises, and ground areas of the privatized and to be privatized enterprises and objects were received by the data bank reflecting systemized information.

In January-April about 250 immovable properties were leased by legal and natural persons. In the past period of 2009 ground area of about 80 objects were leased. At the same time to more than 120 lessees were sent notices about the rental dept to the state budget. During the report period about 50 statements of claim about the lessees not paying the rental were sent to courts. Given the statements of claim raised in the previous periods about 40 judicial decisions were taken. In January-April 2009 about 3050 payments were made by legal and natural persons through automated payment system. In the report period, receipt of 1,7 mlm manats to the state budget from the lease of the non-residential areas and ground areas of the privatized enterprises and objects was provided.

On May 1, 2009 information about 6200 state enterprises with the status of legal person and 11,6 mln  immovable properties owned by their branches (totally 11050) was registered in the Central Register.

In January-Aprel of the current year technical passports of about 400 enterprises and objects were drawn. Moreover, plan-drawings of about  1800 non-residential areas were drawn. During first four months of 2009 more than 500 certificates were given to applicants by the committee. These are the certificates about the sale of state property to legal and natural persons, privatization of the ground areas and acquisition of right to property.

In order to improve the management and privatization works of the state property, sustainable use of the state property the State Committee for the Management of the State Property made a number of structural changes. The purpose of the structural changes is the removal of replication in the duties and functions of certain departments of the Committee and improvement of the efficiency of the activity.

During the conference, the committee chairman made orders to the responsible persons of the central body and chiefs of the subordinate agencies about the enhancement of the efficiency of the state property management, acceleration of the privatization, increase of attention to the conservation of state property, provision of responsiveness to the applications made by citizens and legal persons, taking of necessary measures for the ensuring of transparency.

The chairman of the committee emphasized the importance of certain emergency measures for the increase of efficiency of the work of territorial and district departments and  removal of shortcomings and issued commissions to the chiefs of territorial and district departments concerning these issues.

        

Practice of Germany in the restructuring of state properties is learned

              

In order to restructure and improve pre-privatization state properties, as well as improve the measures for the support of the privatized enterprises, the State Committee for the Management of the State Property continues the works on adoption of the practices of the developed countries, exchange of experience in the sphere and cooperation with international agencies.

With this purpose, on April 23, 2009 a seminar dedicated to the practice of Germany in the restructuring of state properties was held in Baku with the support of German Technical Cooperation Society (GTZ). The seminar was attended by the workers of central agency and territorial departments of the committee, as well as by German experts. In the frames of the seminar restructuring mechanisms and direction in various spheres of economy, the practice of Germany in the measures concerning the field was learnt.

    

The deputy chairman of the State Committee on the State Property Management Rustam Shahbazov addressing the seminar said that the committee attaches a great importance to learning of international experience in the restructuring of state enterprises and infrastructure fields. For these purposes in the last year the committee took appropriate measures for the adoption of the practice of European countries in the field of restructuring of state enterprises.

To gain the practical knowledge in the sphere and implement the exchange of practices, visits were made to a number of foreign countries. It was noted that in the last the with the support of German Technical Cooperation Organization in Baku and other regions of the country there were held seminars and trainings dedicated to assessment, privatization methods and instruments, privatization practice of the countries with transitional economy, privatization practice of developed countries.

It was also noted, that this year in the field of the management, restructurization and development of the state properties a realization of a number of various measures is planned.

It should be noted that, the main purpose in restructuring and development measures  is the preparation of the state enterprises to for privatization, increase of the attractiveness for investors, and increase of competitiveness of the produces goods.  The State Committee for the management of the state property renders methodical and consultative assistance to  restructuring and development of enterprises. For this purposes, in 2008 the Committee take measures for informational and consultative assistance to the drawing of programs for pre-privatization restructuring and development of a number of enterprises.

During the seminar, the project manager of the GTZ a Vulf and Shmider and expert Verner Heintze gave an information about restructuring and development measures, adaptation of enterprises to modern market economy principles and other issues.

It was noted that the experience of Germany gained in the field plays a great role in the restoration of activities of enterprises, opening o new jobs, and other social issues.

After the seminars the attendees were granted certificates.
